The document, labeled as a first draft of the majority opinion [written by Justice Alito], includes a notation that it was circulated on Feb. 10. Deliberations on controversial cases have in the past been fluid. Justices can and sometimes do change their votes as draft opinions circulate and major decisions can be subject to multiple drafts and vote-trading, sometimes until just days before a decision is unveiled.

A person familiar with the deliberations said that four of the other Republican-appointed justices had voted with Alito, and that line-up remains unchanged. The three Democratic-appointed justices are working on one or more dissents. How Chief Justice John Roberts will ultimately vote is unclear.
