    Reports by the Privacy and Civil Liberties Oversight Board (PCLOB), [a government watchdog agency], looked into programs conducted under Executive Order 12333. When Edward Snowden revealed warrantless bulk data collection by the government, Congress responded by banning collection under a separate statute, the Foreign Intelligence Surveillance Act (FISA). Congress left EO 12333 alone.

    The only clues to what program was evaluated [by the PCLOB] come from a partially declassified letter from Sens. Ron Wyden and Martin Heinrich. The letter suggests that the program involved collecting bulk data “entirely outside the statutory framework that Congress and the public believe govern this collection.”

    “Under Executive Order 12333 the government is not allowed to target particular Americans [...] But it hardly matters because if the government can conduct bulk surveillance overseas it's going to pick up Americans' data in the process," [said an expert from the Brennan Center for Justice].
