- Tucker Carlson talking about the nothingburger “Twitter files,” and *not* January 6, if you can believe it!

Almost two years since the January 6 insurrection, its impact on the trajectory of American politics remains enormous, no matter how vociferously Republicans try to change the subject.
-
Rep. Bennie Thompson (D-MS) announced that the January 6 committee will issue criminal referrals to the Justice Department based on its investigation, though there is still debate underway in the committee about how broadly to accuse disgraced former president Trump and his allies of crimes.. The panel is working against the clock to recommend charges, because when Republicans take control of the House in January, the presumptive next House speaker, Kevin McCarthy, has not only promised to disband the committee, but to retrospectively undermine its findings with Republican-led hearings. Sounds like a productive use of everyone’s time! The January 6 committee finished its final witness interviews last week.
-
Special Counsel Jack Smith (will never get over how generic this man’s name is) has subpoenaed local officials in three states central to Trump’s plan to overturn the 2020 election: Arizona, Michigan, and Wisconsin. These are the first known subpoenas issued since Attorney General Merrick Garland appointed Smith last month to oversee the insurrection case, as well as Trump’s theft of classified documents. The subpoenas suggest that the Justice Department is broadening its examination of the circumstances leading up to January 6. All of the records requests name Trump specifically, as well as employees and attorneys for his campaign.
-
Although a number of January 6 insurrectionists have been held legally accountable for their actions, some have already crept back into Republican politics. A former West Virginia House delegate named Derrick Evans, who served three months in federal prison for his role in January 6, announced today that he is launching an exploratory bid for Congress. Evans served only a little over one month in the House of Delegates before he resigned following his arrest.

Things got interesting today at a congressional ceremony honoring the officers who protected the Capitol during the insurrection.
-
All of Congress’ senior leaders participated in an event today to present U.S. Capitol Police officers, Washington, DC, Metropolitan Police, and other responders who acted with bravery in the face of large-scale violence on January 6, with the Congressional Gold Medal. Police officers being honored and some of their family members pointedly declined to shake hands with Senate Minority Leader Mitch McConnell and House Minority Leader Kevin McCarthy, both of whom have minimized the gravity of the events of January 6, voted against investigating the event, and welcomed Donald Trump back into the American political fold.
-
U.S. Capitol Police officer Brian Sicknick suffered strokes and died one day after responding to the insurrection, and when his family accepted the medal on his behalf, they skipped McCarthy and McConnell. When asked about the snub, Sicknick’s mother Gladys said, “They’re just two-faced…I’m just tired of them standing there and saying how wonderful the Capitol police is and then they turn around and … go down to Mar-a-Lago and kiss his ring and come back and stand here and sit with – it just, it just hurts.” The decision to honor the Capitol responders with Congressional Gold Medals (the highest honor Congress can bestow) was passed unanimously by the Senate, but the House bill passed with opposition from 21 Republicans.
Come this January, Kevin McCarthy will try to erase any vestiges of Republican complicity and participation in the January 6 insurrection; it’s on responsible citizens, elected Democrats, and journalists not to let him succeed.

A class-action lawsuit filed in October alleges that the federal government has illegally broken a promise to pay off the debts of a group of Black farmers. That agreement was violated after a group of White farmers filed a lawsuit objecting to their “exclusion” from a program meant to address racially discriminatory practices in USDA farm loans. The president of the National Black Farmers Association said that the new programs to help farmers in financial distress don’t match the USDA’s earlier offer to pay off 120 percent of the debt of farmers who are socially disadvantaged. This definition applies to more than 6,500 Black, Latino, Native American, Native Alaskan, Asian American, and Native Hawaiian and Pacific Islander farmers. The USDA had initially proposed payments following a long history of the agency refusing to process loans from non-White farmers, particularly Black farmers. The U.S. government settled a similar 1999 lawsuit filed by Black farmers and paid more than $2.4 billion, but court filings acknowledged that discriminatory practices in USDA farm loans persisted. Many Black farmers who expected financial relief from the initial deal invested in their farms, and will therefore be in even worse financial shape than before now that the agreement has been broken.

Polls closed at 7pm Eastern in the Georgia Senate runoff. You know we've got you covered tomorrow.
The Supreme Court heard arguments in the much-maligned “Independent State Legislature Theory” case today. Fingers crossed the Supreme Court doesn’t decide to further upend American democracy!
Argentinian Vice President Cristina Fernández de Kirchner has been convicted of a fraud scheme in which she gave a major public-works contract to a family friend while she was the first lady and then president. She has been sentenced to six years in prison and is banned from holding public office. Corruption girl boss!!
Texas Secretary of State John Scott, a top Republican election official, resigned yesterday, having run into the same problem many Republican election officials are facing around the country: that the Big Lie has caused conservative voters to not believe in the validity of any election results.
The suspect accused of opening fire in a gay nightclub in Colorado Springs, CO, killing five people and wounding 17, was charged by prosecutors today with 305 criminal counts including hate crimes and murder.
Non-traffic-related police fines have surged in France’s poorer and minority communities, prompting criticism of French President Emmanuel Macron’s “tough on crime” policies.
A European Union privacy watchdog agency ruled that Facebook’s parent company Meta cannot run ads based on a user’s personal data and will need the user’s consent to do so.
Speaking of Meta, an internal oversight board harshly criticized the company today for policies that give celebrities, politicians, and business partners special treatment in sharing posts that would otherwise be removed for violating company policies.
Brian Pritchard, a conservative local talk show host in Georgia who regularly espouses the Big Lie, allegedly voted illegally nine times while serving a felony sentence in a $33,000 forgery and theft case. These guys always deliver.

The Biden administration hopes to seize momentum from a strong midterm-election showing in which tens of millions of voters rebuked abortion restrictions, but officials are running in to serious roadblocks. The famous Planned Parenthood v. Casey precedent restricts federal funds from being spent on broadening abortion access, Congress is divided and unwilling to pass legislation which would give more assistance to those seeking the procedure, and the illegitimate, right-wing Supreme Court is how we got here in the first place. But some reproductive-rights advocates and former government officials still say that President Biden can and should go further than his July and August executive orders. A former Department of Health and Human Services secretary said that HHS could expand federal protections for health-care providers, life-saving abortions, abortion pills, and travel for women in abortion-restricted states. An inter-agency effort between HHS, DOJ, the Federal Trade Commission, and even the Department of Veterans Affairs could fill in many of the gaps growing larger by the day in post-Dobbs America. Voters showed up to oppose draconian abortion restriction in November. It’s the president’s turn to show up for them.
