Yes - Before making final judgement I would be curious as to where the courts would classify their written work. Unlike songwriters unless a comedian writes a book we don't typically see or access the written work, often the songwriter is a separate individual from the performer, and unlike a comedy script songs are specifically covered under copyright law. To further complicate this if this were to be validated the writing for any performance could be viewed as a separate copyright issue. Even your nightly news has writers.


Unsure - Comedy is only partly about the joke. The timing and delivery are a bigger part. While I agree there is creativity in coming up with...
