    The Supreme Court heard arguments Wednesday in a case that could fundamentally reshape the U.S. election process. The case revolves around an obscure legal concept called Independent State Legislature theory. It was brought by Republican state legislators in North Carolina seeking a rejection of the NC Supreme Court's overturning of their gerrymander.

    Lawmakers argued that state legislatures are the ultimate arbiters of federal elections, and that state courts have no more authority over state election laws than they do federal ones. The conservative justices appeared open to some aspects of the idea but skeptical of other parts.

    Justice Kagan said ISL doctrine, if empowered, would "[get] rid of the normal checks and balances" and could enable extreme gerrymandering. Justice Alito disagreed with the argument that ISL theory would give state legislatures unfettered power, saying Congress can always establish rules for federal elections. Lawyers arguing against the theory said it would cause confusing differences between federal and state elections.
