Why did Fox News and Dominion settle instead of going to trial?

  1. Summary
Immediately before Dominion Voting Systems' defamation lawsuit against Fox News was set to go to trial, Delaware Superior Court Judge Eric Davis said a settlement was reached. Fox agreed to pay $787 million to resolve claims that it lied about Dominion's voting machines' integrity during the 2020 election. "We acknowledge the Court's rulings finding certain claims about Dominion to be false," Fox said, citing a previous judgment.

When Davis rejected Fox's motion for a summary judgment weeks ago, he noted some of Fox's claims about Dominion were "defamatory per se." He also rejected Fox's claims that it was merely reporting allegations by former President Trump, among other defenses. The result was Fox's defense would need to rely on the claim it did not act with "actual malice."

Although Dominion obtained documents indicating that top Fox officials did not believe election fraud claims, potentially damaging Fox's defense, proving malicious intent is a high bar. The settlement is half of what Dominion originally sought, and will not require Fox to issue retractions.

Do you expect AI to improve your experience using the internet?

HIGHLIGHTED COMMENTS

No - I've watched developments in AI with great interest and regularly use AI-enhanced tools such as this site. It’s an exciting new era. Will AI improve the internet experience overall? Functionally, I think so, and I know in many ways it already has. But I'd be (pleasantly) shocked if it did anything to improve our circumstances online socially. [...] We’ve barely begun to address the myriad ways the modern internet has rendered us unrecognizable and hostile to ourselves and each other. Dropping AI/LLMs/generative models into this, with their perfect imitation of our speech, our ideas, our faces, our voices, seems like a totally insane idea.
