  1. Summary
    On Thursday the Supreme Court upheld the Indian Child Welfare Act. The 1978 law gives Native American families preference in the adoption of Native American children. A white foster couple seeking to adopt a Native American child, backed by Texas, sued five tribes and the Interior Department over the law, arguing it creates illegal racial preferences.

    The tribes argued they are political entities, not a race, and that a ruling against the ICWA would have severe repercussions for other tribal protections. The 7-2 majority opinion sidestepped the debate on race, focusing instead on Congress's authority to pass laws about tribes.

    In dissent, Justices Alito and Thomas said the ICWA exceeds federal authority and puts children at risk. Critics of the ICWA say it keeps foster children from loving homes and defines "Indian child" as a biological category. Justice Kavanaugh, part of the majority, suggested the alleged racial preference deserves further debate. The American Academy of Pediatrics supports the law, saying it redresses "intergenerational pain."
