    The Supreme Court has overturned the stalking conviction of Billy Counterman, a Colorado man who sent thousands of Facebook messages to a budding musician, some implying threats. The case concerned whether Counterman's speech was a "true threat," or speech that is exempt from constitutional protection according to Supreme Court precedent.

    Colorado's stalking law does not require that prosecutors prove intent to intimidate. It defines stalking as speech that "would cause a reasonable person to suffer serious [distress]." Counterman, citing his mental illness, argued he did not intend to intimidate and that prosecutors should have to prove intent before speech loses its First Amendment protection.

    The American Civil Liberties Union argued a ruling in favor of Colorado would chill regular speech, while Colorado said its law narrowly focuses on repeated speech made towards individuals, not an audience. The 7-2 majority opinion found that prosecutors do not have to prove intent, but still have to prove a speaker is aware their statements could be threatening.
