  1. Summary
    The Supreme Court ruled 6-3 against race-conscious admissions at Harvard and the University of North Carolina, overturning decades of precedent. UNC was accused of violating the 14th Amendment's promise of equal legal treatment. Harvard was accused of violating the 1964 Civil Rights Act, which bars discrimination in schools receiving federal funds.

    "College admissions are zero-sum. A benefit provided to some applicants but not to others necessarily advantages the former group at the expense of the latter," Chief Justice John Roberts wrote for the majority. Roberts rejected the argument that affirmative action improves diversity, saying a student's race does not necessarily make their perspective unique.

    In dissent, Justice Sonia Sotomayor said the ruling subverts the 14th Amendment by "entrenching racial inequality in education." Also in dissent, Justice Ketanji Brown Jackson said "deeming race irrelevant in law does not make it so in life." The majority said universities may still factor in an applicant's discussion of how race has affected their life.

Context: Supreme Court ruling defines what counts as a "true threat" that is exempt from the First Amendment.

No - If the person making repeated comments doesn’t know or feel the threatening nature of such behavior, it is still frightening and harmful to the victim, perhaps worse because the perpetrator thinks such behavior is an act of affection, or some such positive feeling. If the law included innocent by reasons of insanity and involved incarceration in a mental hospital until able to understand and feel the harmfulness of such behavior, then maybe this ruling would make sense. But just because a person is incapable of grasping the frightening qualities of his or her behavior should not make it ok.
