  1. Summary
    Last Friday the Supreme Court ruled 6-3 against President Biden's student loan forgiveness plan. The ruling came in two decisions: the first case concerned two student borrowers who sued because they were ineligible for the debt relief, while the latter involved six Republican-led states that argued the plan would harm state tax revenue. The court unanimously rejected the first challenge but upheld the second.

    The ruling found that the Biden administration's reliance on the HEROES Act was unconstitutional. The 2003 law allows the Education Secretary to modify student loans in a national emergency, with the administration citing the pandemic as the emergency. The majority said that the original law does not grant the authority for the planned mass debt cancellation and that Biden would need Congress to authorize such a plan.

    In response, President Biden has said his administration will try again using the Higher Education Act of 1965, which would not require a national emergency. Sen. Elizabeth Warren had advocated that route in 2020.

Yes - I don't like all the consequences this case may have. I'm certainly for diversity in racial and other dimensions on campus and in society. [...] But I feel this court decision is right in principle and better in the long run. I worry that simplistic admission decisions based on race (or any immutable characteristic) foster racial resentment and division (some legitimate - e.g., Asian students held to higher standards for being Asian). I believe using economic criteria and things like school quality are much better on that count -- even though it is certainly true that race can add a disadvantage on top of those factors.
