How is the governor of New Mexico limiting the right to carry firearms?

Source: City of Albuquerque

  1. Summary
New Mexico Gov. Michelle Lujan Grisham on Friday suspended the right to carry firearms in public (openly or concealed) in localities that average more than 1,000 violent crimes per 100,000 residents per year or 90 gun-related emergency room visits per 100,000 from July 2022 to June 2023. Only Bernalillo County and its seat, Albuquerque, meet the standard. The suspension lasts for 30 days but can be renewed.

Grisham made the move after declaring gun violence a public health emergency. She cited recent fatal shootings of three children, as well as two mass shootings that occurred earlier in the year. Grisham said that gun violence is the leading cause of death for children aged 1-19 in the state.

A gun-rights group that is suing over the policy calls it unconstitutional, citing a 2022 Supreme Court ruling that overturned New York's limits on public gun possession. George Mason law professor Robert Leider says the order appears unprecedented. Grisham welcomed legal challenges and said "No constitutional right, in my view [....] is intended to be absolute."

HIGHLIGHTED COMMENTS

No - Throw the book at people who use molotov cocktails but otherwise no, this is plainly excessive and unprecedented. I guarantee you would be less likely to join an activist group or a protest if you thought you could be charged with racketeering (or terrorism) because someone else in the group went too far. And those who say "it's just a charge, not a conviction,"[...] People take plea deals for unjustified charges they can't spare the time or money to fight, they impact housing and employment, etc. Charges alone can deter protected speech and that's why this is wrong.
