  1. Summary
    On Thursday Tennessee enacted a ban on gender-affirming care for minors and a novel restriction on drag performances. The latter bans “adult cabaret entertainment” on public property or in locations where it can be viewed by minors. Such entertainment includes "topless dancers, go-go dancers, [...] strippers, male or female impersonators.” First-time offenders will get a misdemeanor, while subsequent offenses will be felonies.

    State Sen. Jack Johnson, who sponsored the bill, said it "is not targeting any group of people. It does not ban drag shows in public. It simply puts age restrictions in place to ensure that children are not present at sexually explicit performances." Critics noted the state already has obscenity laws.

    The American Civil Liberties Union said drag performances are still legal, because the bill "bans obscene performances, and drag is not inherently obscene." 14 states are considering similar laws. Jerry Cox, president of the conservative Family Council, said the first wave of bills are trials for future legislation, as many may not withstand First Amendment challenges.
