  1. Summary
    In Sackett v. EPA, the Supreme Court cut the agency's authority to regulate wetlands under the Clean Water Act. The case stems from an Idaho couple who tried to build a home. The EPA ordered them to stop, saying their property contained wetlands protected by the CWA. The Court unanimously ruled the homeowners should not have been targeted by the agency.

    However, a 5-4 split emerged in the concurring opinions over how to determine what qualifies as "waters of the United States," subject to EPA authority. The majority opinion written by Justice Alito noted that the EPA targeted the couple because the property was by a ditch that fed into a creek, which fed into a lake, and that by that standard, virtually all landowners would be at risk of regulation.

    But Justice Kavanaugh was joined by three liberal justices in a concurring opinion that said the majority went too far in limiting the scope of the CWA, writing that the ruling would have "significant repercussions for water quality and flood control throughout the United States."
